العقد الالكتروني في مواجهة الجريمة المعلوماتية

الملخص
أدى التطور العلمي و التكنولوجي السريع الى تحول مفهوم التجارة التقليدية إلى ظهور التجارة الالكترونية وبرز منها العقد الالكتروني كأهم آلياتها، وحيث أن الاعتراف بوجود العقد الإلكتروني قانونا لا يكون إلا بوضع مجموعة من الترتيبات التشريعية الإلزامية على المستوى الوطني والدولي، دفعت إلى وجوب الوقوف أمام اهمية التدابير التشريعية لحماية نظم المعلومات، وهي الجريمة المعلوماتية التي شكلت وتشكل تهديد لهذا العقد. وتعتبر الجريمة المعلوماتية من جرائم العصر، التي جاءت على إثر تطور التقنيات الحديثة والتكنولوجيا، بحيث أصبحت مواجهة هذا النوع من الجرائم تحديا أمام الدول. The rapid scientific and technological development has led to the transformation of the concept of traditional commerce into the emergence of electronic commerce،and the electronic contract has emerged from it as its most important mechanism،and since the legal recognition of the existence of an electronic contract can only be made by establishing a set of mandatory legislative arrangements at the national and international level،which prompted the necessity of standing In view of the importance of legislative measures to protect information systems،which is the information crime that has formed and is a threat to this contract. Information crime is considered one of the crimes of the times،which came on the heels of the development of modern technologies and technology،so that confronting this type of crime has become a challenge for states.
