دور القاضي الوطني في تطبيق أحكام المحاكم الدولية

الملخص
تتمتع قرارات الأجهزة القضائية الدولية عموما بقدر من السلطة والاحترام لدى المشاركين في الدعوى، وينشأ عن الحكم درجة عالية من الاستجابة والتوافق فالطبيعة الملزمة لقرار محكمة عادة لا تخضع لأي شك، وعادة ما تؤكد الأدوات الدستورية المنشئة للأجهزة القضائية الدولية على الطبيعة الملزمة لأحكامها، وليس من المدهش إدراك ذلك فمن المفترض أن يخضع اختيارا الى القضاء الدولي بكون لديه الاستعداد الكافي للالتزام بما يصدره هذا القضاء. ونظرا لأهمية قرارات محكمة العدل الدولية كأحد المؤسسات القضائية الدولية الهامة فسوف نقوم في الصفحات التالية بإلقاء الضوء على مدى تأثير قراراتها على القاضي الداخلي ومدى احترام هذا الأخير لها ومدى إمكانية استعانة الأفراد بهذه الأحكام لتأييد ادعاء اتهم في الدعوى الوطنية فالقاضي الوطني وهو بصدد بحثه عن مدى أهمية حكم المحكمة أن يبحث عن مدى أهمية ومكانة هذا الحكم في النمو المتزايد للعلاقات الدولية، ومدى مساهمته في نبذ العداء بين دول العالم، ولا ينظر بمعزل عن التطورات الدولية ولكن ينظر إليه كعنصر في عملية أكبر من الاتصالات والعلاقات التي يعبر فيها ترس صغير ضمن مجموعة من التروس تدبر الآلة المسماة" الجماعة الدولية". Abstract: The decisions of the international judicial bodies generally enjoy a degree of authority and respect among the participants in the lawsuit, and the judgment gives rise to a high degree of responsiveness and concordance. It is not surprising to realize that it is supposed to be subject to the choice of the international judiciary that he is ready to adhere to what is issued by this judiciary. Given the importance of the decisions of the International Court of Justice as an important international judicial institution, in the following pages we will shed light on the impact of its decisions on the internal judge and the extent of respect for the latter and the possibility of individuals to use these judgments to support the prosecution of the accused in the national case. The national judge, in his search for the importance of the court's judgment, is looking for the importance and the status of this ruling in the growing growth of international relations, and the extent of his contribution to the rejection of hostility between the countries of the world, and is not seen in isolation from international developments, but seen as an element in a larger process Of contacts and relationships in which a small gear crosses within a group of gears manages the machine called the "international community"
