الأسس الحديثة للمسؤولية المدنية في مجال الأضرار البيئية

الملخص
ملخص: الهدف من هذه الدراسة هو تبيان دور قانون حماية البيئة من خلال المبادئ التي تبناها في بلورة أسس جديدة للمسؤولية المدنية لها طابع وقائي يمكن الاستناد عليها في رفع دعوى المسؤولية المدنية للمنشآت الملوثة للبيئة، أو يمكن القول بأن هذه المبادئ قد أثرت بشكل كبير في النظام التقليدي للمسؤولية المدنية، فتتمثل هذه الأسس في كل من مبدأ الاحتياط، ومبدأ الملوث الدافع. اهم نتيجة توصلنا اليها من خلال البحث هي أنه في مجال حماية البيئة أصيحت المسؤولية تلعب ثلاثة أدوار، الدور الوقائي، الاصلاحي، والردعي، ولهذا تم الاصطلاح في الاتفاقيات الدولية وعلى المستوى الأوربي على هذا النوع من المسؤولية التي تمس بالبيئة وتسبب اضرارا لها بالمسؤولية البيئية. Abstract: The objective of this study is to shed light on the role of environmental protection law through the principles it has retained to crystallize new foundations of preventive civil liability on which to rely to initiate a action in civil liability of installations polluting the environment, where we can say that these principles have greatly affected the traditional system of liability. These foundations are represented in the precautionary principle and the polluting mobile principle. The most important result that we have achieved through research is that in the field of environmental protection, responsibility has become three roles, the preventive, corrective and dissuasive role, and for this reason, in international agreements and at European level, this type of liability that affects the environment and causes damage to it has been called environmental liability. Résumé : Le but de cette étude est de montrer le rôle du droit de la protection de l'environnement à travers les principes qu'il a adoptés dans la cristallisation de nouveaux fondements de la responsabilité civile à caractère préventif sur lesquels s'appuyer pour engager une action en responsabilité civile des installations polluant l'environnement. , ou l'on peut dire que ces principes ont beaucoup affecté le système Le principe traditionnel de responsabilité civile, ces fondements sont représentés dans le principe de précaution et le principe du pollueur-payeur. Le résultat le plus important auquel nous sommes parvenus grâce à la recherche est que dans le domaine de la protection de l'environnement, la responsabilité est devenue trois rôles, le rôle préventif, correctif et dissuasif, et pour cette raison, dans les accords internationaux et au niveau européen, ce Le type de responsabilité qui affecte l'environnement et lui cause des dommages a été appelé responsabilité environnementale.
