مبدأ حسن الجوار كأساس للمسؤولية الدولية عن الضرر البيئي

الملخص
ملخص: يجمع فقهاء القانون الدولي أن موضوع المسؤولية الدولية موضوع معقد وغامض، ويزيد تعقيده إذا تعلق الأمر بالأضرار البيئية، فالقواعد التقليدية للمسؤولية أصبحت لا تواكب التطورات الحاصلة في العالم لذا يجتهد الفقهاء في استحداث قواعد جديدة، ومن بين الحلول المقترحة مبدأ حسن الجوار الذي لم تستكشف محتوياته بالشكل الكافي، لذا تأتي هذه المساهمة لتحديد وتوضيح العناصر الأساسية لحسن الجوار، وعرض مختلف المواقف بخصوصه وكذا مدى تكريسه في الوثائق الدولية. وقد لاحظنا أن الجوار لم يعد يعني القرب الجغرافي، وأن مبادئ حسن الجوار أصبحت تنطبق على البلدان التي تفصل بينها البحار والمحيطات بفضل قانون البحار الجديد، ورأينا أن المبدأ بدء يكسب أهمية متزايدة لما يتيحه من حلول في إسناد المسؤولية لمصدر التلوث، حتى بدون ارتكاب هذا الأخير أي خطأ. كلمات مفتاحية: المسؤولية الدولية، الضّرر البيئي، حسن الجوار Abstract: International law experts agree that the subject of international responsibility is complex and ambiguous, and more complex if it comes to environmental damage, as traditional responsibility rules have become incompatible with developments around the world, so Scholars are striving to develop new rules, among the proposed solutions is the principle of good neighborliness, whose contents have not been adequately explored, so this contribution comes to identify and clarify the basic elements of good neighborliness, and to present various positions on it as well as the extent to which it is enshrined in international documents We have noticed that neighborhood no longer means geographical proximity and that the principles of good neighborliness have become applicable to countries separated by seas and oceans thanks to the new law of the sea, and we have seen that the principle is beginning to become more and more important because of the solutions it provides by attributing responsibility to the source of pollution, even without the source of the pollution making an error.
