الملخص
الملخص: إن الجدل الفقهي الثائر بشأن الطبيعة القانونية للمهمة التحكيمية، بين اتجاه يرى أن لها طبيعة قضائية، وآخر يرى أن لها طبيعة تعاقدية، واتجاهات اخرى ترى أن للمهمة التحكيمية طبيعة مختلطة أو خاصة، يجعل تحديد الطبيعة القانونية لعملية عزل المحكم أمرا عسيرا، نظرا لتداخل الطبيعة القضائية لمهمة المحكم بالطبيعة التعاقدية للعلاقة التي تجمع أطراف النزاع بالمحكم، وتأثير كل منهما في الأخرى، من هنا سنحاول في هذه الدراسة بحث الطبيعة القانونية لعزل المحكم. Abstract: The rebellious doctrinal controversy regarding the legal nature of the arbitral mission, between a trend that sees it as having a judicial nature, and another that believes that it has a contractual nature, and other trends that see that the arbitral mission has a mixed or special nature, makes determining the legal nature of the process of dismissal of the arbitrator difficult, given the overlap of the judicial nature The task of the arbitrator is the contractual nature of the relationship between the parties to the dispute with the arbitrator, and the effect of each on the other, from here we will try in this study to examine the legal nature of the arbitrator’s dismissal.
