الملخص

تعتبر الأملاك الوقفية سنة ونظاما لحفظ المال لتحقيق الاستقرار وهي باب من أبواب الفقه الإسلامي وما فيها من نصوص شرعيّة وتفصيلات فقهاء المذاهب الإسلامية، وهي في الحدّ ذاته باب أيضا من أبواب التشريع الجزائري من خلال النصوص القانونية والتنظيمية التي خصّها بها مراعيًا في ذلك أحكام الشريعة الإسلامية، فهي نظام مؤسساتي قائم بحدّ ذاته، تتمتّع بالشخصية المعنويّة، لذا وجب إخضاع هذا النظام المؤسّساتي إلى حماية خاصّة تضمن حصانته، فضمان بقاء الملك الوقفي واستمراره ودوافعه مرتبط بالتصرّفات التي تجلب المصلحة وتدفع المفسدة وفق أحكام الشريعة الإسلامية والصياغة القانونية التي تقنّن تلك الأحكام. The.
