منهج الإمام مالك-رحمه الله-في تفسير الكلالة

الملخص
موضوع هذا البحث يتعلق بمنهج الإمام مالك في تفسير الكلالة وبيان أحكامها ،حيث عقد في كتاب الفرائض في الموطأ بابا في ميراث الكلالة أورد فيه حديث زيد بن أسلم أنّ عمر بن الخطاب-رضي الله عنه- سأل رسول الله صلى الله عليه و سلم عن الكلالة فقال له رسول الله صلى الله عليه و سلم يكفيك من ذلك الآية التي أنزلت في الصيف آخر سورة النساء. و لماّ كانت أحكام الكلالة مختلفة ،فقد بيّن الإمام مالك المعنى المراد منها ورفع الإشكال الوارد عليها،فبيّن حقيقتها ،وقرّر أنها على وجهين حيث حمل الآية الأولى على توريث الإخوة للأم في حال عدم وجود الأصل والفرع الوارث ، وبيّن الوجه الثاني منها وحمله على ميراث الجد مع الإخوة الأشقاء أو للأب،واحتج على ذلك بالإجماع وعمل أهل المدينة ، كما بيّن من حيث النظر أوجه ميراث الجد مع الإخوة Summary: The subject of this research relates to the approach of Imam Malik in the interpretation of kalala and the clarification of its rulings, where it was held in the book of the statutes in al-Muwatta Baba in the legacy of the fatality in which the hadith of Zaid bin Aslam mentioned that Omar bin al-Khattab - may God be pleased with him - asked the Messenger of God, may God bless him and grant him peace, said: The Messenger of God, may God bless him and grant him peace, has enough for you from that verse that was revealed in the summer at the end of Surat al-Nisa.And when the rulings of kalala are different, the Imam Malik clarified the meaning of it and raised the problem presented to it. With the brothers or the father, and protested this unanimously and the work of the people of the city, as shown in terms of consideration aspects of the legacy of the grandfather with the brothers
