الملخص

تهدف هذه الدراسة إلى تقديم رؤية قانونية حول الهيئة المكلفة بإدارة العملية الانتخابية في الجزائر في ظل التعديل الدستوري لسنة 2020 ، وذلك بإبراز نموذجها و الاطار القانوني لتكوينها العضوي والهيكلي ودراسة مدى تأثيره على استقلاليتها عن مختلف السلطات خاصة السلطة التنفيذية. وقد اعتمدنا المنهج الوصفي التحليلي مدعما بالمنهج المقارن وهذا لتناسبه وطبيعة الموضوع، وقد توصلنا من خلاله الى جملة من النتائج ترتكز في الاساس على أن التعديل الدستوري الاخير دعم فعلا مكانة السلطة المستقلة للانتخابات بان جعلها من المؤسسات الدستورية إلا انه اضفى مزيد من الضبابية على استقلاليتها. كلمات مفتاحية: الإدارة الانتخابية. الهيكلة العضوية. التعديل الدستوري. الاستقلالية. السلطة المستقلة. This study aims to provide a legal vision about the body in charge of managing the electoral process in Algeria under the constitutional amendment of 2020, by highlighting its model and legal framework for its organic and structural composition and examining its impact on its independence from various authorities, especially the executive branch, and we adopted in that descriptive analytical approach supported by the comparative approach. The results of this study indicate that the constitutional amendment as a standard value for the establishment of the Independent National Electoral Authority, although it has already supported its legal status, has added further uncertainty to its independence on the organic and structural aspect, especially in its relationship with the executive branch, which portends the difficulty of overcoming the crisis of confidence that characterized many of the previous electoral entitlements.
