الطبيعة الخصوصية لاختصاص الغرفة التجارية لدى مجلس قضاء الجزائر في مجال المنافسة

الملخص
يكرس المشرع الجزائري اختصاصا استثنائيا للغرفة التجارية لدى مجلس قضاء الجزائر العاصمة للنظر في جزء كبير من الطعون المقدمة ضد قرارات مجلس المنافسة رغم أن هذا الأخير كُيف بهيئة إدارية مستقلة، وبالنظر إلى القواعد العامة في توزيع الاختصاص بين القاضي الإداري والقاضي العادي فإن هذا الاختصاص يعود للقضاء الإداري . النظرة السطحية في هذا التوزيع الاستثنائي للاختصاص القضائي تظهر بأن الغرفة التجارية لمجلس قضاء الجزائر ينعقد كقاضي عادي إلاّ أن التعمق في دراسة نقل الاختصاص تظهر بأنه يتحول إلى قاضي إداري. The Algerian legislator dedicates an exceptional jurisdiction to the Chamber of commerce at the Algiers Judicial council to consider a large part of the appeals against the decisions of the competition council, although the latter was determined by an independent administrative body, and given the general rules in the distribution of jurisdiction between the administrative judge and the ordinary judge, this jurisdiction belongs to the administrative judiciary. A superficial look at this exceptional distribution of jurisdiction shows that the chamber of commerce of the Algerian judicial council convenes as an ordinary judge. However, a deeper study of the transfer of jurisdiction shows that it turns into an administrative judge.
