فتاوى الإمام التُّسولي (ت1258ه) التي لم يوردها في نوازله -جمعاً ودراسةً-

الملخص
يتلخّص موضوع البحث في جمع فتاوى الإمام علي بن عبد السلام التّسولي المالكي رحمه الله (ت1258ه) بغية تقريبها وتيسير الوصول إليها، وتمهيداً للنّهل من فقه هذا الإمام الفذّ والإفادة من اجتهاداته، وهي عبارةٌ عن فتاوى لم يوردها في نوازله: «الجواهر النّفيسة فيما يتكرّر من الحوادث الغريبة»، فجاء البحث في مقدّمة وأربعة مباحث وخاتمة. مفتتحاً المبحث الأوّل بترجمةٍ مختصرةٍ لصاحب الفتاوى أتطرق من خلالها إلى ذكر اسمه ونسبه ومولده، ثمّ شيوخه وتلاميذه، ثمّ وفاته وآثاره، وفي المبحث الثّاني تعريفٌ بنوازله المخطوطة؛ مبيّناً حقيقتها ونسبتها إلى مؤلّفها، ثمّ مضمونها وما احتوت عليه، ثمّ ذكر لنسخها الخطيّة، أمّا المبحث الثالث ففيه بيان لمنهجه العام في الإفتاء، والمبحث الرّابع فيه رصدٌ للفتاوى التي أفتى فيها بنفسه ولم يوردها ضمن نوازله المجموعة، وختمت البحث بذكر أهمّ النّتائج والتي من أبرزها أنّ للإمام التّسولي خمسة فتاوى لم ينقلها ضمن نوازله وهي مبثوثةٌ في ثنايا ثلاثة مصادر: حاشيته على لا مية الزقّاق، وشرحه على تحفة ابن عاصم، والنّوازل الصغرى للمهدي الوزاني رحمه الله. This study revolves aound the collection of the fatwas of Imam Ali Ibn Abd Al-Salam Al-Toussouli al-Maliki (d.1258 AH). It aims at bring these Fatwas closer and facilitate access to them, and at paving the pay to benefiting from the jurisprudence and of this unique Imam; it is Fatwas non mentioned in his contemporary issues Jurisprudence «aljawahir annafissa fi ma yatakarrar mina lhawadith Alghariba». The first chapter deals with a brief translation of the author of the fatwas, through which I touched upon mentioning his name, lineage, and birth, then his sheikhs and students, his death and its effects. The second chapter presents an introduction to his contemporary issues' manuscripts, indicating its truth and ascribing it to its author, then its content and what it contained, and then mentioning its written copies. While the third chapter contains an explanation of its general approach to fatwas. As for the fourth one, it monitors the fatwas in which he issued a fatwa himself and did not include it among his collected contemporary issues. This research concludes with the most important findings, among which; The Imam Al-Toussouli has five fatwas that he did not transmit among his collection, and they are included in three sources: Hachiya a'la Lamiyat Ezzoukak, his explanation of Tohfat Ibn Asim, and Ennawazil Assoughra of al-Mahdi al-Wazzani, may Allah have mercy on him.
