مبدأ المنافسة في إبرام عقود تفويض المرفق العام

الملخص
يعتبر مبدأ المنافسة من أهمّ المبادئ الّتي تحكم مرّحلة إبرام عقود تفويض المرفق العامّ، ذلك أنّ نجاح مثل هذا النوع من أساليب تسيير المرافق العامّة مرتبط أساسًا بحسن اختيار المفوّض له، وحسن اختيار المفوّض له لا يمكن أن يتأتّى إلّا من خلال تكريسٍ فعالٍ وواضحٍ لمبدأ المنافسة وما يفرضه هذا الأخير من إتباع طرق و إجراءات محددّة يتوجّب على السّلطة المفوّضة الالتزام بها عند إبرامها لعقود التّفويض، ومنّه فإنّ هذه الدراسة تهدف إلّى تسليط الضوء على مبدأ المنافسة في إبرام عقود تفويض المرفق العام، وذلك من خلال التطرّق إلى الإطار المفاهيمي لكلّ من التّفويض والمنافسة، ثمّ إلّى الآليّات الّتي وضعها المشرّع الجزائريّ من أجل ضمان تكريس فعّال للمنافسة Abstract: The competition principle is considered as one of the most important principles that governs the stage of signing the mandate contracts of the general facility, the success of this kind of public facilities management is related to the good choice of the commissioner. The good choice of the commissioner can not be ; only through effective and clear consecration of the competition principle , and what this last imposes regarding the techniques and the procedures that the delegated authority must comply with when signing the mandate contracts . Therefore, this article aims to highlight the competition principle in signing the mandate contracts of the general facility, by addressing the conceptual framework of both the authorization and the competition, then the mechanisms that are set by the Algerian legislator in order to ensure effective consecration of the competition.
