الطبيعة القانونية لمسؤولية منظمي المسابقات الرياضية

الملخص
تحتل الرياضة مكانة هامة في المجتمع سوآءا بالنسبة للمتفرجين أو الرياضيين، وبغض النظر ان كانت تمارس كهواية أو تتخذ كمصدر رزق، غير ان هذا التطور والتزايد في اعداد المتابعين واللاعبين أدى إلى إلزامية تدخل الدولة لتنظيم هذا النشاط عن طريق قوانين ولوائح، وهذا لحماية كل المساهمين في النشاط الرياضي وتحديد مسؤولية كل طرف وكذا جزاء المترتب عن الاخلال بالالتزامات الملقاة على كل طرف. ولعل أهم الفاعلين في المجال الرياضي هم منظمي المسابقات الرياضية والمكلفين بتوفير خدمة الممارسة والمشاهدة للمستهلك وبالتالي فهم مسؤولين عما يلحق بالمستهلك من ضرر، غير أن هذه المسؤولية تثار حولها عده تساؤلات لاسيما تلك المتعلقة بالطبيعة القانونية لها. كما ان الطبيعة القانونية لمسؤولية منظم النشاطات الرياضية تتطلب إظهار الالتزامات الملقاة على عاتق كل طرف من الأطراف المساهمة في عملية تنظيم النشاط الرياضي وهذا قصد تحديد المسؤول وطبيعة المسؤولية وتحديد من هو ملزم بالتعويض جراء الخطأ او التقصير المولد للمسؤولية. الكلمات المفتاحية: النشاط الرياضي. المسؤولية. التأمين عن الأضرار. منظمي التظاهرات الرياضية. المسؤولية العقدية. المسؤولية التقصيرية. Also, the legal nature of the responsibility of the organizer of sports activities requires showing the obligations incumbent on each of the parties involved in the process of organizing the sports activity, and this is in order to determine the person responsible and the nature of the responsibility and to determine who is obligated to compensate for the error or negligence that generates responsibility.
