الملخص
الملخص : يلزم المكلف الامتثال لأمر الشارع بفعل المطلوب الواجب أو المندوب ، مع تفاوت مراتبهما في درجات الطلب. لكن قد يكون فعل المستحب مفضولا غير مطلوب بالنظر إلى مآله في بعض مواقع الوجود ، لفوات مقصوده ، كأن يكون مفضيا إلى فساد و ضرر، أو لطرو المعارض الراجح ، و مِن ذلك معارضته مصلحة شرعية رابية توجب العدول عنه ، نحو مصلحة تأليف قلوب المسلمين و استدامة وحدتهم و اجتماع كلمتهم ، فعندئذ يتعين التوسل بترك المندوب لتحصيل المصالح العالية ، و لا إنكار على المخالف ، إذ التنازع في رجحان بعض المستحبات على بعض لا يفسد العبادات ، و قد شهدت لذلك بالاعتبار قواعد الشريعة و مقاصدها.
