الملخص
ترومُ هذه الدِّراسةُ الدَّندنةَ حول الفقه السِّياسي في الشَّريعة الإسلامية من زاوية " الفَرض الكفائي" ؛ هذا الحكم الشَّرعي الذي أتى عليه ردحٌ من الزَّمن نُكب فيه ، حتَّى حُصر أو كادَ في الـمُثُل الفقهية الـمُتعلِّقة بقضايا المصير ، وهُمِّشَ دورُه في آفاق الحياة ، ولاسيَّما في الحياة السِّياسية للأمَّة . تلكَ النَّظرةُ التي أسهمتْ في تَعميق الهُوَّة بين واقع الحياة السِّياسية والأحكام الفقهية ؛ فكانتْ العاقبةُ أنْ تردَّتْ الأمَّة -عبْر أحقابها -في أُتُون الاستبداد والفساد السِّياسي . بيْدَ أنَّ الله قيَّض الإمامَ الشَّاطبي لنَفْثِ رُوح الحياة من جديد في هذا الحكم الشَّرعي ؛ فقيَّد أوابدَهُ وضمَّ شواردَهُ ؛ ونقله منْ دائرة الـجُمود إلى مَيدان الإبداع ، وأضفى عليه وظيفة الإصلاح السِّياسي ، وألزمَ الأمَّة جمعاءَ بضرورة هذا الإصلاح ومسؤوليتها الشَّرعية ، بُغيةَ الانتهاض بحالها وتصحيح مسارها ومَصيرها . Abstract : This study aims to humble about political jurisprudence in Islamic law from the angle of "efficient obligation"; This legal ruling that a period of time has been devolved upon him, until he was confined or almost to the jurisprudential ideals related to fate issues, and his role in the horizons of life was marginalized, especially in the political life of the ummah. That view that contributed to widening the gap between the realities of political life and jurisprudential rulings. The consequence was that the nation fell - through its eras - into the furnace of tyranny and political corruption. However, God calmed Imam Al-Shatibi to breathe out the spirit of life anew in this Islamic ruling. So he restricted his life and annexed his estates; He moved it from the stalemate to the field of creativity, gave it the function of political reform, and obligated the entire nation to the necessity of this reform and its legitimate responsibility, in order to rise in its condition and correct its course and destiny.
