ارتفاقات الطيران الجوي و أثرها على المحيط العمراني و البيئي في المناطق المحيطة بالمطارات

الملخص
ملخص: لعّل أهم ميزة في النقل الجوي مقارنة بطرق النقل الأخرى هي قدرته على نقل الأشخاص و الأشياء في الأوقات القصيرة جداً، غير أنّ هذه الميزة لا تعد الوحيدة، بل يضاف إليها ميزة الأمان التي يتمتع بهذا هذا النمط من أنماط التنقل، و ما ذاك إلاّ بتظافر جملة من العوامل منها حجم التقنية المدمج في مجال صناعة الطيران، و كذا جملة المعايير المتحكمة في تسيير الخدمات الأرضية على مستوى المطارات، مناطق الإركاب و الإنزال و تفريغ البضائع، خدمات الجمركة، الشرطة و العبور. و بهدف تمكين المطارات من القيام بوظائفها على الوجه الأكمل فقد تم تزويدها بمجال من الحماية سمي بارتفاقات الطيران المتعلقة بالتوسعة، و التي من شأنها إمداد المطارات بمساحات إضافية تمكنها من الاستجابة للطلب المتزايد على قطاع النقل الجوي من خلال أنشطة التوسيع و إعادة التهيئة. و لم يكتف المشرع بحماية مرفق النقل الجوي براً فقط، بل مدّ نطاق الحماية حتى إلى المجال الجوي، من خلال الالزام بتجهيز بعض العوائق و الحواجز بإشارات ضوئية للدلالة عليها ليلاً أو نهاراً، و هذا تحت مسمى ارتفاقات الطيران المتعلقة بالإرشاد. و تأتي هذه الدراسة إلى البحث عن المبررات التي وقفت وراء إقرار جملة هذه الارتفاقات، و دورها في تأمين سلامة الطيران الجوي، و كذا إلى تأثيرها على الوسط العمراني و البيئي في المناطق المحيطة بالمطارات. Abstract:The Most important advantage of air transport over other modes of transport is its ability to transport people and objects in a very short time, this capacity is once again an important factor in determining the obligations of the parties, Regardless of the speed, air transport is the most secure mode, as it is undoubtedly one of the safest means of transport, due to the combination of a number of factors, Including the level of technology used in the aeronautical industry, as well as, all the standards that govern the conduct of ground services. In order to allow airports to fully achieve their objectives, they have been provided with a protective field called aeronautical easements of clearance. The legislator extended the scope of air transport protection even to the air space, requiring that certain obstacles and barriers be equipped with light signals to indicate them day and night, under the name of aeronautical easements of beaconing. This study has just sought to obtain justifications for approval of all these easements and, their role in securing air transport, as well as their impact on the urban environment and the environmental sphere in the vicinity of airports. résumé:L'avantage le plus important du transport aérien par rapport aux autres modes de transport est sa capacité de transporter des personnes et des objets dans un temps très courts, cette capacité est encore une fois un facteur important dans la détermination des obligations des parties, en dehors de la rapidité , le transport aérien est le mode le plus sécurisé, car il est incontestablement l’un des moyens de transport les plus sûrs, en raison de la combinaison d’un certain nombre de facteurs, y compris le débit de la technologie intégrée dans l'industrie aéronautique, ainsi que l'ensemble des normes qui régit la conduite des services au sol. Afin de permettre aux aéroports de concrétisé pleinement leurs objectifs, ils ont été dotés d'un champ de protection appelé servitudes aéronautiques de dégagement. Le législateur a étendu la portée de la protection de transport aérien même à l'espace aérien, en exigeant que certains obstacles et barrières soient équipés de signaux lumineux pour les indiquer de jour comme de nuit, sous le nom des Servitudes aéronautiques de balisage. Cette étude vient de chercher les justifications d'approbation de toutes ces servitudes, leur rôle dans la sécurisation de transport aérien, ainsi que leur impact sur l'environnement urbain et environnemental aux voisinages des aéroports.
