الحرية في سياق الجدل المقاصدي: دراسة في ضوء منهجية التقصيد الشرعي للكليات

الملخص
يتناول هذا البحث بعض جوانب النقاشات والجدالات التي عرفها البحث المقاصدي قديمًا وحديثًا، وقد جعل من مسألة الحرية نموذجًا وموضوعًا للجدل الحديث الذي عرفه الفكر المقاصدي، باعتبارها أكثر قيمة حظيت باهتمام كبير. فقد رأى البعض أن الحرية تحتلُّ مكانة مهمة في بنية الشريعة ومنظومتها المقاصدية، غير أنه لا يمكن أن تصنَّف ضمن الكليات المقاصدية. وفي المقابل يرى آخرون أن الحرية جديرة بأن تضاف إلى الكليات الخمس باعتبارها إحدى القيم الضرورية التي دعت الشريعة الإسلامية إلى تمثُّلها ورعايتها، فضلاً عن كونها أكثر القيم الإنسانية إلحاحًا وطلبًا في العصر الحديث. وبناء على ذلك حاول البحث رصد أهم النقاشات التي عرفها موضوع الحرية في سياق الجدل المقاصدي المتعلق بمنظومة المقاصد الكلية، وما إذا كانت هذه المنظومة قابلة للزيادة في مكوناتها وفق منطق العلم ومنهجية بناء المقاصد، لينتهي البحث إلى وضع قيمة الحرية في إطارها الذي يتعين وضعها فيه، من خلال تحديد مجال انتمائها في الخريطة المقاصدية. الكلمات المفتاحية: الحرية، المقاصد، الكليات، الضروريات الخمس. Freedom in the context of Maqasid debate A study in the light of the methodology of comprehensive Shariah Objectives Abstract This paper was an attempt to explore some aspects of the debates and controversies in Maqasid Al Shariah research in the past and present time. Since freedom received considerable attention, it was presented as a topic which reflects the present debates of Maqasid thought. Some considered freedom to be an important part of the structure of Islamic law and its Maqasid system but could not be classified within the five necessities. Some others argue that freedom should be added to the five necessities as one of the essential values, that Shariah has called for it to be represented and nurtured, and one of the highly demanded human values of modern time. In view of this, the elaborations focused on the main debates about freedom in the context of conceptual debate related to Maqasid necessities system, and whether the components of this system can be further developed according to the logic of science and methodology of shariah objectives construct. the findings suggested that the value of freedom was placed within its appropriate framework by determining its area of interest in the Maqasid framework.
