حكم إجهاض الجنين المشوه (دراسة مقارنة)

الملخص
موضوع الإجهاض واحد من المواضيع التي مازالت إلى يومنا هذا تثير العديد من المشاكل القانونية والاجتماعية والشرعية، باعتباره يمس أحد أهم حقوق الإنسان ألا وهو الحق في الحياة. وفي هذا البحث سنحاول استعراض واحد من أهم الأسباب التي تدفع بالكثير من الأمهات إلى إسقاط الأجنة ألا وهو تشوه الجنين، الذي جعل الكثير من الآباء في حرج من أمرهم لعدم تحققهم من هذه المسألة إلى جانب عدم وجود حكم فاصل محل إجماع حول هذه المسألة. وسنحاول في هذا البحث عرض مفهوم تشوه الجنين وأسبابه، مبرزين موقف التشريعات العربية والغربية إضافة إلى حكم الشريعة الإسلامية بكل تفريعاته وتفصيلاته، من خلال ما ورد من أحكام في كتاب الله وسنة الرسول الكريم صلى الله عليه وسلم، وفتاوى الفقهاء والعلماء وقرارات المجامع والهيئات العلمية والفقهية. The issue of abortion is one of the topics that to this day still raises many legal, social and legal problems, as it affects one of the most important human rights, which is the right to life. In this research, we will try to review one of the most important reasons that lead many mothers to abort fetuses, which is the deformity of the fetus, which made many fathers embarrassed by their lack of verification of this issue in addition to the absence of a final ruling that is unanimous on this issue. In this research, we will try to present the concept of fetal deformity and its causes, highlighting the position of Arab and Western legislation, in addition to the rule of Islamic law in all its subdivisions and details, through what was mentioned in the provisions of the Book of God and the Sunnah of the Noble Messenger, may God bless him and grant him peace, and the fatwas of jurists and scholars and the decisions of academies and scientific and jurisprudential bodies.
