سوسيولوجيا الزواج العرفي في الجزائر

الملخص
الزواج نظام قائم على الأعراف والتقاليد حيث كان ولا زال أساس تكوين الأسرة وغايته إنجاب الأطفال وبناء أسرة مستقرة، حيث يعتبر عقدا قانونيا مدنيا من جهة وعقدا شرعيا من جهة أخرى، فهو يحظى بقدر كبير من الأهمية الاجتماعية والتقديس الديني، إلا أننا نجد تجاوزات سواء قانونية أو شرعية تعطي أنواع مختلفة من الزواج ومن هذه الصور الزواج العرفي الذي ينتشر في الدول العربية، ومن سماته افتقاره للرسمية إضافة إلى عدم تسجيله لدى السلطات المختصة. ويعتبر الزواج العرفي في الجزائر زواجا صحيحا من الناحية الشرعية فهو يشمل جميع أركان وشروط الزواج ، إلا أن عدم توثيقه في السجلات الرسمية يسبب العديد من المشاكل داخل الأسرة ومنه إلى المجتمع، وتعددت أسباب الزواج العرفي في الجزائر فمنها الاجتماعية والاقتصادية والقانونية، لهذا سنتطرق في هذا المقال لتحليل بعض الأسباب التي تدفع بالأفراد لاختيار الزواج العرفي بدل الزواج الرسمي من خلال بعض الحالات من ولاية الأغواط وهذا عن طريق دراسة استكشافية للموضوع بالمنطقة Marriage is a system based on customs and traditions Where it was and still is the basis of family composition and its goal to have children and build a stable family, Where it is considered a civil legal contract on the one hand and a legitimate contract on the other, It enjoys a great deal of social importance and religious sanctification, Where we find legal or legitimacy irregularities that give different types of marriage and such images customary marriage, which spreads in the Arab countries, It is characterized by its lack of official as well as non-registration with the competent authorities. The customary marriage in Algeria is a legitimate marriage in terms of legality. It contains all the elements and conditions of marriage, But the lack of documentation of customary marriage in official records causes many problems within the family and from it to society, The causes of customary marriage in Algeria are multiple, including social, economic and legal, In this article,we will analyze some of the reasons that drive individuals to choose customary marriage instead of formal marriage through some cases from the state of Laghouat, and this is through an exploratory study of the subject in the region.
