الوسائل السلمية في تسوية المنازعات الدولية في القرآن الكريم والسنة النبوية

الملخص
ملخص: تناولت الدراسة إشكالية استعمال الوسائل السلمية في تسوية المنازعات الدولية في ضوء القرآن الكريم والسنة النبوية، وبينت مدى توافقها واختلافها مع القانون الدولي، وذلك من خلال مبحثين، مفهوم المنازعات الدولية وأنواعها كالسلمية السياسية نحو المفاوضات والمساعي الحميدة والوساطة والتحقيق والتوفيق، وكالقضائية مثل التحكيم والقضاء، ومفهوم الوسائل السلمية وإدارتها في القرآن الكريم، ثم تطرقت لتحريم الحرب والعدوان في السنة النبوية وتسوية المنازعات الدولية بطريق الصلح، وقد التزمت بالمنهج المقارن لتناول المسائل بين الفقه الإسلامي والقانون الدولي واستفدت من المنهج الوصفي في ضبط مفاهيم الوسائل السلمية والمنازعات الدولية، وقد توصلت في النهاية إلى نتائج وتوصيات أهمها أن الوسائل السلمية في حل النزاعات الدولية في الوحي الإلهي تتخلف عن الوسائل السلمية في حل النزاعات الدولية في القانون الدولي لكنها تتكامل مع بعضها لتشكل منظومة شاملة متكاملة. Abstract: The study dealt with the problem of using peaceful means in settling international disputes in the light of the Holy Qur’an and the Sunnah of the Prophet Muhammed, comparing with the international law, through two topics in each topic has two subjects, the concept of international disputes and their types such as political peace towards negotiations, good offices, mediation, investigation and conciliation, and as well as judicial such as Arbitration and judiciary, the concept of peaceful means and their characteristics in the Noble Qur’an, international disputes in the Noble Qur’an and the management of peaceful relations in the Holy Qur’an. She touched on the prohibition of war and aggression in the Prophet’s Sunnah and the settlement of international disputes by way of reconciliation. In controlling the concepts of peaceful means and international disputes, and ultimately reached conclusions and recommendations, the most important of which is that peaceful means in resolving international disputes in the divine revelation behind peaceful means in resolving international disputes in international law, but they .complement each other to form a comprehensive and integrated system
