حجية التوقيع الإلكتروني في إثبات عملية التحويل المصرفي الإلكتروني

الملخص

ملخص: أدى التطور التكنولوجي والتقني في المعاملات المصرفية الإلكترونية إلى ضرورة البحث عن وسيلة ناجعة تستعمل لتوثيقها ذلك أن الوسائل التقليدية أصبحت لا تحاكي الطفرة التكنولوجية، مما استوجب إدخال التوقيع الإلكتروني محل التوقيع التقليدي ليتوافق وطبيعة التصرفات القانونية، وكذا إبرام العقود التي تنفذ باستعمال الوسائل التقنية الحديثة. اعترف المشرع الجزائري للتوقيع الإلكتروني بالقيمة الكاملة والحجية في إثبات المحررات الإلكترونية وساواه مع التوقيع التقليدي متى توافرت فيه الشروط المحددة قانونا، وبالتالي فالتوقيع الإلكتروني له القيمة القانونية الكاملة في إثبات التحويل المصرفي الإلكتروني. كلمات مفتاحية: التحويل الإلكتروني للأموال، وسائل الدفع، التوقيع الإلكتروني، المعاملات الإلكترونية، حجية الإثبات. Abstract: The Technological and technical development in the electronics banking treatments led to the necessity of discovering new efficient means that is used to reinforce this development , that is why the traditional technical means became useless in terms of the speed of technology , that is the reason why it becomes necessary to use electronic signing is stead of the traditional signing so as to be appropriate and normal with the legal behaviors and with the signing of contract to be used in conformity with the modern technics conformity with the modern technics. The Algerian legislator has recognized the electronic signature described as the full and authoritative value of the electronic proof of proof, with the traditional signature, when the legally established conditions have been fulfilled. The electronic signature has the full legal value of proof the electronic bank transfer.
