تحقيق العدالة البيئية في اطار تفعيل متطلبات التنمية المستدامة ـــــــ دراسة لبعض نماذج الدول الرائدة في مجال التمكين للعدالة البيئية ـــــــ

الملخص
يواجه المجتمع المعاصر تهديد المشكلات البيئية، و أظهرت الدراسات أن أخطرها تتمثل في قلة الموارد المائية و التلوث بشتى أنواعه و نقص الوعي البيئي، إضافة إلى غياب العدالة الإجتماعية و العدالة البيئية، خاصة بالنسبة للمناطق المهمشة و الفقيرة التي تعاني من حقوق العدالة البيئية في المياه النظيفة و الحق في العيش في بيئة صحية و الحصول على المعلومات البيئية و الشفافية البيئية، و حقها في تحقيق العدالة داخل الجيل نفسه و بين الأجيال في سياق تحقيق مساعي التنمية المستدامة. لذلك كانت حماية البيئة ومواردها الآخذة في التناقص من الالتزامات الرئيسية وإحدى المتطلبات الضرورية لتحقيق التنمية المستدامة، كما أن رفع مستوى الوعي حول الحقوق البيئية من شأنه اكمال جهود الحكومات لرسم السياسات البيئية المستدامة وتنفيذها، بالتمكين لطبقات المجتمع الفقيرة و المهمشة و ذات الدخل المحدود و الأقليات منها بشكل خاص ؛ و اتخاذ الاجراءات القانونية للحيلولة دون نشوء بؤر للثلوث البيئي في المناطق التي تسكنها، وهو هدف الورقة الحالية التي تبحث في امكانية وضع أسس قانونية واجراءات تنفيذية وطنية و دولية لأجل تحقيق عدالة بيئية ضمن متطلبات التنمية المستدامة و في اطار تحقيق الإنصاف في توزيع الفوائد و التكاليف البيئية و التمكين لحق الإنسان في بيئة صحية. Since current societies face environmental problems, numerous studies have shown that the most serious of these problems is the lack of water resources, pollution, and the lack of environmental awareness; in addition to the lack of both social and environmental justice, especially in remote and poor areas that lack the most fundamental rights of getting clean waters, living in healthy environment, and getting access to environmental information, as well as their right to achieve justice within the same generation and between generations in the context of sustainable development efforts. For this reason, the protection of the environment and the responsible management its decreasing resources is among the environmental obligations and essential conditions for achieving sustainable development. Also, raising awareness about environmental rights will complement governments' efforts to develop and implement sustainable environmental policies by (1) empowering the poor, marginalized, and low-income classes of society, in particular, and (2) taking legal actions to prevent the emergence of hot spots of environmental pollution. The purpose of the present paper is to examine the establishment of legal frameworks and national and international implementation measures to achieve environmental justice within the context of sustainable development, and to promote greater equity in the distribution of environmental benefits and costs for enabling the human’s right to a healthy environment.
