جريمة الاجهاض -قراءة في العوامل والاثار -

الملخص
يعد الإجهاض من الظواهر التي عرفت تزايد خلال الآوانة الأخيرة ، وهذا تماشي مع التغير الاجتماعي والقيمي الذي عرفته مجتمعاتنا ، وقد فرضت الظاهرة نفسها كحدث في يومياتنا ، فبالرغم من أن هذه الظاهرة قديمة قدم الإنسانية وكانت تستخدم فيها وسائل تقليدية ويتم الاستعانة بها لأسباب اجتماعية واقتصادية أو لأسباب طبيبة وذلك حفاظ على صحة المرأة وحياتها، إلا انه اليوم نجد أن لجوء الكثيرات للإجهاض والتي صنفت كجريمة يعاقب عليها القانون كان كنتيجة لانحلال الأخلاقي والممارسات اللاعقلانية التي قد تقع فيها الفتيات والتي تكون نهايتها طفل غير شرعي خارج إطار الزواج فتلجأ الكثيرات لإجهاض كوسيلة لردم وإخفاء هذه الفضيحة والوصم الاجتماعي. حيث يشارك فيها كل من الطبيب الذي تخلى على مبادئه وأخلاقيات مهنته من اجل المال والولي اللامسؤول الذي يخاف من الفضيحة . لطالما كان الإجهاض من الطابوهات والمواضيع الحساسة التي لا تزال تثير النقاش والجدل وكمحاولة منا جاء هذا المقال ليسلط الضوء على هذه الظاهرة والجريمة ، مرتكزين على استعراض أهم التعاريف، مع إبراز مختلف جوانب وإبعاد هذه الجريمة ، أنواعها والعوامل والأسباب الكامنة وراء حدوثها ، أهم الوسائل المعتمدة فيها وآثارها ومخاطرها على الصعيدين المجتمعي والفردي. Abstract: Abortion is one of the phenomena that has been known to increase in recent times, and this is in line with the social and value change that our societies have known, and the phenomenon has imposed itself as an event in our diaries, although this phenomenon is as old as humanity and it used traditional means and is used for social and economic reasons or for reasons A doctor in order to preserve the health and life of the woman. However, today we find that many women resorting to abortion, which was classified as a crime punishable by law, was a result of the moral degeneration and irrational practices in which girls may fall and the end of which is an illegitimate child outside marriage, so many resort to abortion as a means of bridging and concealing this scandal And social stigmatization. Both the doctor who abandoned his principles and the ethics of his profession for the sake of money and the irresponsible guardian who is afraid of scandal participate in it. Abortion has always been one of the taboos and sensitive topics that continue to spark debate and controversy. As an attempt by us, this article came to shed light on this phenomenon and crime, based on reviewing the most important definitions, highlighting the various aspects and dimensions of this crime, its types, factors and reasons behind its occurrence, the most important means adopted in it.
