الجدار العازل وموقف محكمة العدل الدولية ( منذ جوان 2002 الى يومنا هذا)

الملخص
الملخص: إن من أهم خروقات إسرائيل للقانون الدولي بناء الجدار العازل، في الأراضي الفلسطينية المحتلة، بما في ذلك القدس الشرقية وما حولها؛ بحجة أن الجدار ذو طبيعة مؤقتة، وأنه وضع استجابة لمقتضيات أمنية بحتة، و الحجة نفسها تذرعت بها قبل في بناء المستوطنات التي أصبحت واقعا مفروضا. الجدار بخصائصه زاد من تقييد الفلسطينيين ومصادرة أملاكهم، والتحكم بمصادر المياه والحياة الاقتصادية والاجتماعية والاستلاء تدريجيا على كل فلسطين بعد إخلائها من سكانها، أو محاصرة الفلسطينيين في سجن كبير بعيدا عن العالم الخارجي؛ وهذا ما تصدت لمحكمة العدل الدولية في سنة 2004م بقرار جاء في مضمونه: أن بناء إسرائيل للجدار يخالف القانون الدولي، وعلى دولة إسرائيل إيقاف أعمال البناء، وتعويض الفلسطينيين عن كل الأضرار التي نجمت عن بنائه. Abstract: Indeed, the construction of the partition wall is one of the rudest israeli violations’ of the international law, in the occupied territories’ of palestine including jerusalem, and all the ground around. Therefore, under the pretext of security requirement’s the wall was built temporary as a response to these needs as they assumed. The same argument was used already, when building their settlements, which now become an imposed fact. Moreover, the characteristics’ of the wall increased restrictions on the palestinians, and confiscated their properties, beside the overall control of the palestinians’ water sources, economic life, and even the social one in a way to takeover gradually the occupied land, after evacuating its original population , or trapping it in a big prison far away from the outside world. The thing that was not allowed, but confronted by the international court of justice in 2004. The decision said: israel is breaking all the rules by building the wall it must stop any construction work immediately and in parallel it must also compensate all the damages caused behind this building to the palestinian people.
