تأديب الموظف عن افشاء السر المهني في قانون الوظيفة العامة الجزائري

الملخص
يعتبر السر المهني من أهم الالتزامات الواقعة على عاتق الموظف، فبحكم وظيفته قد يطلع على معلومات سرية تخص الإدارة والأفراد، يلتزم بكتمانها وعدم إفشائها لأن في ذلك مساس بالمبادئ الأخلاقية بدرجة أولى و إحداث ضرر بالمصلحة العامة والمصلحة الخاصة بدرجة ثانية، و نظرا للأهمية البالغة لكتمان السر المهني و لخطورة إفشائه، أحاطه المشرع الجزائري من خلال قانون الوظيفة العامة بحماية خاصة و افرد له قواعد مميزة، حيث اعتبر كل فعل إفشاء للأسرار المهنية صادر عن الموظف دون عذر شرعي خطا تأديبي، يرتب مساءلته التأديبية من طرف الجهة المختصة بالتأديب وفق إجراءات تأديبية كرسها قانون الوظيفة العامة و في المقابل منح الموظف المخطئ جملة من الضمانات التي من شأنها حمايته من تعسف الإدارة. The professional secret is considered one of the most important obligations that are incumbent upon the employee by virtue of his/her functions. The employee may exposed to secret information related to administration and individuals that he/she has committed himself/herselfin keeping and not disclosing it, because this would violate the ethical principles in the first place and cause harm to the public interest and the private interest in a second place.Due to the great importance of safeguarding confidentiality and disclosing information, the Algerian legislature has devoted numerous articles to the protection of professional secrets and has, therefore, incorporated special rules in which,any conduct, constituting an act of disclosing professional secrets,was classified as a serious disciplinary fault,punishable by the disciplinary authority in accordance with the disciplinary procedure set out in the Civil Service Law. The legislature, in return, hasestablished a set of safeguards, which must be granted to the employee to protect him/her against any arbitrary administrative decision.
