جريمة اختطاف الأطفال: قراءة في سيوسيولوجية الظاهرة والأحكام التشريعية المنظمة لها بين دواعي الردع والحماية الاستباقية

الملخص
تعد ظاهرة اختطاف الأطفال من أخطر الجرائم التي تهدد كيان الأسرة وأمن المجتمع؛ نظرا لكونها تمس بالطفل الذي يعد أضعف مخلوقات البشرية وأولاها بالحماية والرعاية، خصوصا وأنها ذات امتدادات وصلة بجرائم أشد خطورة، كالقتل، والإخفاء القسري، والمتاجرة بالأعضاء البشرية، والاغتصاب؛ الأمر الذي ينبغي معه انتهاج سياسة جنائية شاملة وفعالة ترتكز على محوري الحماية الاستباقية والردع لمواجهتها والحد من انعكاساتها السلبية. لذا سنحاول في هذه الدراسة تقديم رؤية سيوسيوقانونية في مفهوم الظاهرة وأسبابها وخصائصها، والجرائم ذات الصلة، والوسائل الكفيلة بالحد منها ومواجهتها. وصولا إلى تشديد العقوبة على مرتكبيها بتفعيل عقوبة الإعدام باعتبارها الأكثر نجاعة وعدلا وردعا، بعيدا عن سياسات المهادنة والتذرع بحقوق الإنسان. The crime of child kidnapping:A reading in the sociology of the phenomenon and the legislative provisions regulating it between the reasons for deterrence and social protection The phenomenon of child kidnapping is one of the most serious crimes that threaten the family and the security of society, as it affects the child who is the most vulnerable among humans, and whose protection is a priority. This phenomenon is that serious for it has extensions, and is linked to more serious crimes, such as murder, forced disappearance, human organs trade, and rape.Dealing with such a phenomenon requires a comprehensive and effective criminal policy based on the axes of proactive protection and deterrence to confront it and limit its negative repercussions. Therefore, in this study, we will try to present a socio-legal vision in the concept of this phenomenon, its causes, characteristics, the related crimes, and the means to reduce and confront it, as well as well reinforcing the punishment for its doers by activating the death sentence, as it is the most effective, just and deterrent, away from the policies of appeasement and the invocation of human rights..
