الملخص

تهدف هذه الدراسة إلى البحث عن السبل والآليات التي تعمل على تكريس مبدأ الأمن القانوني ضمن النظام القانوني الجزائري، حتى يضمن الأشخاص استقرارا لأوضاعهم القانونية، من خلال تمكينهم من التصرف باطمئنان وفق نظام قانوني واضح ومعلوم مسبقا، دون التعرض لتصرفات مباغتة تصدر عن السلطات العمومية في الدولة، يكون من شأنها زعزعة هذا الاستقرار والطمأنينة. وقد خلصنا إلى أن التكريس الدستوري لمبدأ الأمن القانوني في التعديل الدستوري الأخير لسنة 2020، مع توفير الضمانات اللازمة لحمايته، ستمنحه قوة إلزامية ستدفع حتما إلى بناء نظام قانوني فعال، يجسد نموذج دولة القانون المعاصرة في الجزائر، التي تضمن الحماية المثلى لحقوق الانسان وحرياته الأساسية. This study aims to search for ways and mechanisms that work to consecre the principle of legal security within the Algerian legal system, in order for people to ensure the stability of thier legal status, by enabling them to act with reassurance in accordance withe a clear and pre-known legal system, without being exposed to sudden actions by the public outhorities in the state, would destabilize this stability and tranquility. We concluded that the constitutional consecration of the principle of legal security in the last constitutional amendment of the year 2020, while providing the necessary guarantees for its protection, will give it an obligatory force that will invitably puch the building of an effective legal system, embodying the contemporary state of law model in Algeria, which guarantees the optimal protection of human rights and fundamental freedoms.
