حركية أسباب الورود بين الرواية والدراية وفاعليتها في الفقه الحديث النبوي

الملخص
ملخص: الحديث النبوي يتحدث حِينًا ويصمت حِينًا ، يتكشَّفُ مرةً ويتخفَّى مرَّات ، ومهمة فهمه وتفسيره تكمن في اكتشاف ما لم يقله من خلال ما يقوله بالفعل ؛ إذ الكلام الواحد يختلف فهمه بتغير ما يعتريه من عوامل النقل ، وطرائق الأداء ، فلا يستدل على معناه المراد إلا بالقرائن الخارجية وعمدتها مقتضيات الأحوال التي تستدعي معرفة واقع تنزّل الحديث والظروف والملابسات التي قيل فيها وهو ما يسمى ب: أسباب الورود. ومعرفة هذه الأسباب تجعل الباحث مدركا لحقيقة المعنى وأبعاده ، وعارفا لوجه الارتباط بين النص والحكم المستنبط منه ، والحكمة التي تكون في هذا الارتباط . وللوقوف على أبجديات أسباب الورود تم التطرق في هذا البحث إلى تعريف أسباب الورود وعلاقتها بأسباب النزول الخاصة بالقرآن الكريم ، وأقسام ورود الحديث ، ثم استنباط فوائد وأهمية هذه الأسباب ؛ والتي لها أثر في الأحكام وتوجيهها والكشف عن معاني الأحاديث بدقة ووضعها في السياق الذي وردت فيه ، وحل الإشكالات التي قد تنشأ أو نشأت بالفعل عندما يجرّد الحديث من سياقه وخاصة عندما يلاحظ وجود تعارض بين النصوص الحديثية. كلمات مفتاحية: سبب الورود، سبب النزول ، العام، الخاص، المطلق ، المقيد، الناسخ. تصنيف JEL : XN2، XN1. Abstract: The Hadith it somtimes reveals and explains clearly while it does not at other times ;and the task of understanding and interpreting it lies in discovering what he did not say through what he actually says as one speech differs according to the change of what the considers from the transmission factors and methods of performans. Which calls for knowledge of reality comes down to the conversation and the circumstances in which address it : the causes of roses and knowing these reasons makes the researcher aware of the meaning and dimensions of the truth, knowing the aspect of the confusion between the text and the judgment derived from it, and the wisdom that is in this connection . to find out the ABCs of the causes of roses and then address in this research aims to define the causes of roses and their relationship to the causes of revelation related to the HOLY QUR’an, and the divisions of the revelation of the Hadith , then to devise the benefits and importance of these causes that have an effect on the rulings and direct them, to accurately reveal the meanings of the Hadiths and place them in the context in which they are mentioned , and to solve the problems that may arise or have arisen already when it is abstracted . The Hadith is out of context , especially when it is noticed that there is a conflict between the Hadith texts. Keywords: The cause of the roses , The cause of the Descent, General, Special, Absolut.
