الملخص
الملخص: يعتبر تحقيق العدالة والوصول إلى الحقيقة الهدف الأسمى للقانون الجنائي، وقد تضمن هذا الأخير العديد من الآليات والوسائل التي تساعد القضاة على الكشف عن الحقيقة والتطبيق السليم للقانون، ويلعب الشهود دورا مهما في مساعدة الأجهزة القضائية في الوصول إلى الحقيقة، غير أن الشاهد وهو يؤدي هذا الدور قد يتعرض إلى جملة من الأخطار التي تهدد حياته وسلامته الجسدية، وعليه لتعزيز هذا الدور، كان لزاما على المشرع الجزائري أن يتدخل لضمان الحماية اللازمة للشاهد، وذلك بهدف ضمان الحصول على شهاداتهم خدمة للعدالة الجنائية وتحقيقا للعدالة، وهذا ما سعى إليه المشرع من خلال العديد من نصوص القانون الجنائي بشقيه الموضوعي والإجرائي. Abstract: The ultimate goal of the criminal law is to reach the truth and to bring justice to life, these laws provide mechanisms and tools that help magistrates to discover the real facts and thus allow the rigorous application of legislation. Witnesses play a very important role by helping justice agencies to come to the truth, and these witnesses may be victims of many dangers threatening their lives and their physical integrity. To strengthen the role of the witness, the Algerian legislator was obliged to intervene in order to ensure the necessary protection for the witness and consequently to guarantee his testimony and this in favor of the judicial institutions and in favor of justice; this is what the legislator tried to concretecise by the penal code and proceedings.
