الملخص
الملخص: تخريج الفروع على الأصول من العلوم المهمة التي تجمع بين أصول الفقه والمسائل الفقهية، إذ أن الاعتناء بالمسائل الفقهية وما تنبني عليه من أدلة، يورث ملكة فقهية، بها يستطيع المتمكن من هذا العلم ردّ المسائل والنوازل الفقهية الحديثة إلى أصولها، وقد ذكر ابن يونس في كتابه الجامع لمسائل المدونة والمختلطة في باب النكاح بعض القواعد الأصولية المخرّجة على الفروع، فذكر من قواعد الاستصحاب قاعدة " لايُتْرك أمرٌ واجبٌ لأمر قد يكون أو لا يكون "، ومن قواعد عوارض الأهلية قاعدة " الجاهل يعذر لجهله "، ومن قواعد دلالة الألفاظ قاعدة" الأصل في الأوامر أنها على الفور"، ومن قواعد الإجماع قاعدة "إذا كان للسلف قولان لم يجز إحداث قول ثالث بعد انقراضهم "، ومن القواعد المشتركة بين القواعد الأصولية والفقهية قاعدة "إذا اجتمع في شيء الحظر والإباحة يغلب جانب الحظر"، ومن قاعد دفع التعارض بين النصوص قاعدة "الحديث إذا وردت فيه زيادة تردها الأصول كانت الأصول أولى ". Abstract :The graduation of the branches on the principles is one of the important sciences that combine the fundamentals of jurisprudence and jurisprudential issues As taking care of jurisprudential issues and the evidence based on it, inherits jurisprudential knowledge, with which the one who has this knowledge can restore modern jurisprudential issues and problems to their origins. Ibn Yunus mentioned in his book al-Jami 'al-Mudawwana and mixed issues in the chapter of marriage, some of the fundamentalist rules that are produced on the branches, He mentioned: the rules of Alastsahab is the rule of "no matter is left for an order that may or may not be." Among the rules of the symptoms of eligibility is the rule, "The ignorant is excused for his ignorance." Among the rules for the indication of expressions is the rule: "The principle in orders is that they are immediately applied." Among the rules of consensus is the rule, "If the predecessors had two sayings, it is not permissible to make a third saying after their extinction." Among the common rules between the fundamentalist and the jurisprudential rules is the rule "If the prohibition and permissibility are combined together, the prohibition side will prevail." And among the rules for defending the conflict between texts is the rule of "Hadith, if there is an increase in it and its assets are returned, the assets are first."
