الملخص
الملخص: شهد العالم جائحة كورونا (كوفيد-19)، وسارعت الدول إلى إيجاد حلول مؤقتة للوقاية ومكافحة هذا الفيروس في إنتظار التوصل إلى لقاح فعال ضده. والجزائر مثلها مثل باقي دول العالم إتخذت عدة تدابير في هذا الصدد، كما لجأت إلى الاعتماد على لا مركزية القرارات المتعلقة بتلك التدابير من حيث منح الوالي سلطات واسعة ولعل أهمها تسخير الأموال الخاصة، وهو التدبير الذي تضمنته المادة (10) من المرسوم التنفيذي رقم (20/69) المؤرخ في 21 مارس 2020 المتعلق بتدابير الوقاية من إنتشار وباء فيروس كورونا ومكافحته. لذلك إرتأينا البحث في موضوع سلطة الوالي في تسخير الأموال الخاصة لمواجهة فيروس كورونا، نظرا لإرتباط الموضوع بالظروف التي تمر بها البلاد لمواجهة ظروف استثنائية بهدف تحقيق المصلحة العامة، كل ذلك للوقوف على مدى كفايتها وفاعليتها، انطلاقا من الإشكالية التي تثيرها الدراسة حول نطاق سلطة الوالي في تسخير الأموال الخاصة في ظل هذه الجائحة، أمام عمومية النصوص القانونية في الجانب الإجرائي والموضوعي الذي أثار صعوبات في تطبيقها. Abstract: The world witnessed the Coronavirus (Covid-19) pandemic, and countries rushed to find temporary solutions to prevent and combat this virus, pending an effective vaccine against it. Algeria, like the rest of the world, has taken several measures in this regard, and has resorted to decentralizing decisions related to these measures in terms of granting the governor broad authorities, perhaps the most important of which is the exploitation of private funds, which is the measure included in Article (10) of Executive Decree No. (20) / 69) of March 21, 2020, related to the measures of preventing and control the spread of the Coronavirus Therefore, we decided to discuss the the governor’s authority issue to harness private funds to confront Coronavirus, given that the issue is linked to the circumstances the country is going through to face exceptional circumstances aiming to achieve the public interest. Exploiting private funds in light of this pandemic, in view of the of legal texts generality in the procedural and objective aspect that raised difficulties in their implementation.
