الملخص
يجد مجلس الدولة أساس اختصاصه الاستشاري من الدستور والقانون العضوي المتعلق باختصاصاته المعدل و المتمم، بالاضافة الى المراسيم التي جاءت تنفيذا له و كذا نظامه الداخلي، حيث يبدي رأيه وجوبا في مشاريع القوانين التي تبادر بها الحكومة و مشاريع الاوامر الي يبادر بها رئيس الجمهورية فقط، ويجتمع في ذلك على شكل لجنة استشارية ،فيدرس المشروع المعروض عليه من جانبين: جانب شكلي يدرس فيه مدى مراعاة الجهة صاحبة المشروع للإجراءات و الصياغة القانونية، أما من الجانب الموضوعي، فيحرص مجلس الدولة على عدم مخالفة الدستور، والى تقدير ملائمة النص مع المصلحة العامة ويصدر تقريره على شكل رأي لا يلزم الحكومة أو رئيس الجمهورية الأخذ به. The state council finds its basis from the constitution and the organic law that is related to its competencies amended and completed, in addition to its executive decrees and its internal rules. where is obliged to issue its opinion about the project laws held by the government and the project orders by the president only, And it meets in the form of an advisory committee that takes control on the project presented on two sides:A formal side that analyzes to what extent the project owner party has respected the procedures and legal context, an objective side where the state council works on avoiding the constitution violation, and to assess the relevance of the text to the public interest. It issues its report in the form of an opinion that neither the government nor the president are obliged to take it into consideration.
