الرهن الحيازي للمصنف السنيمائي بين الفقه والتشريع

الملخص
يعد عقد رهن المصنف السينمائي من العقود الحديثة، نتيجة للتطور الهائل في مجال الصناعة السينمائية الذي أصبح يتسم بالطابع التجاري والاستثماري، والارتفاع الكبير في حجم تكاليف الإنتاج، لذلك كان لزاما على المنتجين اللجوء إلى التمويل الخارجي عن طريق المؤسسات المالية، التي تشترط تقديم ضمانات حتى تتمكن من تقديم التمويل اللازم لعملية الإنتاج، بالإضافة إلى التطور الحاصل في فكرة الائتمان التي تستلزم تطور فكرة الضمان المتمثلة في إمكانية اللجوء إلى الرهن المصنف السينمائي، وذلك بإبرام عقد الرهن الحيازي على المصنف السينمائي دون حيازته بإعتباره مالا منقولا ذو طبيعة غير مادية، إذ يقوم المنتج برهن المصنف لصالح المؤسسة المالية المقرضة حتى يحصل على التمويل اللازم لعملية الإنتاج، وفي غياب نصوص خاصة تنظم مثل هذه المعاملة تبرز إشكالية مدى كفاية الأحكام العامة في القانون المدني في تنظم عقد الرهن المصنفات السينمائية. the recent decades, as a result of the tremendous development in the field of the film industry, which has become characterized by a commercial and investment character and the large increase in the volume of production costs, so it was necessary for producers to resort to external financing through financial institutions, which require the submission of guarantees in order to be able to provide the necessary financing for the production process, in addition to the development in the idea of credit that necessitates the development of the idea of guarantee represented in the possibility of resorting To mortgage the cinematic artwork, by concluding a mortgage contract on the cinematic artwork without its possessionart as a movable money of an immaterial nature, as the producer pledges the work for the benefit of the lending financial institution in order to obtain the necessary funding for the production process, and in the absence of special law provisions regulating such a transaction, it emerged The problem of non adequacy of the general provisions in the civil law in regulating the mortgage contract of cinematic artworks.
