الملخص
يمر العالم اليوم بموجة من التطورات التكنولوجية والتقنية حيث انجر عنها جملة من النتائج كظهور ثورة الاتصالات الهائلة، بحيث أضحت الأحاديث الشخصية عامة والهاتفية خاصة عرضة للالتقاط والتسجيل والإفشاء، ولعل ظهور اجهزة الاتصال الهاتفي النقالة التي تعتمد النظام اللاسلكي في الاتصال والتي أصبحت في متناول كل الأشخص، وما رافقها من تقدم تقني في تسجيل المكالمات الصادرة منه والواردة اليه حيث اصبحت تلك المكالمات الهاتفية بواسطة تلك الاجهزة الصغيرة والدقيقة عرضة للتسجيل وبطرق مختلفة وبالتالي عرضة للإفشاء. وبالتالي اصبح من اليسير ان نجد العديد من المكالمات الشخصية التي نجريها أو تلك التي قد اجريناها بتلك الاجهزة النقالة قد تم تسجيلها وحفظ تفاصيلها الصوتية الدقيقة وبالتالي قد تقدم كدليل في الاتهام أو في مجال الإثبات الجنائي التي تبنته معظم التشريعات والمواثيق الدولية وأولت له إهتماما كبيرا لما تثيره من إشكالات قانونية والمساس بحرية الأفراد . Abstract : The world is going through a wave of technological and technical developments, resulting in a number of results such as the emergence of the huge communications revolution in which personal public and telephone conversations in particular have become subject to capture, registration and disclosure, and perhaps the emergence of mobile telephone devices that adopt the wireless communication system, which hardly anyone now lacks and the accompanying technical progress in recording calls from him and incoming to him, where those phone calls by those small and accurate devices have become subject to registration and in different ways and therefore subject to disclosure. Therefore, it has become easy to find many of the personal calls that we make or those that we have made with these mobile devices have been recorded and kept their exact audio details and may therefore be presented as evidence in the indictment or in the field of criminal evidence adopted by most of the legislation and international conventions and has given him great attention to the legal problems and the violation of the freedom of individuals
