نحو تكريس شفافية العملية الإنتخابية من خلال السلطة الوطنية المستقلة للإنتخابات

الملخص
إن حماية العملية الانتخابية وضمان شفافيتها ومصداقيتها تتمثل أساسا في تأطيرها جيدا من خلال مجموعة النصوص القانونية التي تنظمها، وهناك مظهر آخر تتجسد من خلاله هذه الحماية يتمثل في الجانب المؤسساتي بإنشاء هيئات مستقلة تتولى مهام تنظيم وضبط العملية الانتخابية بمختلف مراحلها، بداية من القوائم الانتخابية مرورا بالحملة الانتخابية وعملية التصويت وحتى إعلان النتائج فنزاهة الانتخابات مرتبط أساسا بعنصر الحياد الذي تتسم به الجهة المشرفة على العملية الانتخابية. والجزائر كدولة لطالما سعت من خلال تشريعاتها إلى تحقيق منظومة قانونية تجسد من خلالها الشفافية الفعلية للعملية الانتخابية، وفي هذا السياق استحدث المشرع الجزائري بموجب القانون العضوي 19/07 آلية جديدة تتمثل في السلطة الوطنية المستقلة للانتخابات، وهي هيئة مستقلة إداريا وماليا تتمتع بصلاحيات واسعة واردة في القانون المنظم لها.Abstract: The protection of the electoral process and ensuring its transparency and credibility is mainly to frame it well through the set of legal texts it regulates, and there is another manifestation of this protection which is the institutional aspect of establishing independent bodies that will take over the tasks, organizations and control of the electoral process at all stages, starting from the electoral campaign and the voting process, until the announcement of results, the integrity of the elections is mainly linked to the element of neutrality that characterizes the party supervising the electoral process. And Algeria as a country has always sought through its legislation to achieve a legal system that embodies the actual transparency of the electoral process, in this contest the Algerian legislator has introduced under organic law 19/07 a new mechanism: the national electoral authority meant to ensure transparent and fair election, and it is an independent administrative and financial body with broad powers contained in the law governing it.
