الملخص
ملخص: تعد جريمة البناء المخالف لأحكام الرخصة من أكثر المخالفات إنتشارا في الجزائر رغم صدور ترسانة من القوانين الخاصة بمجال التعمير، إلا أن الوضع الذي تعيشه المدن الجزائرية سيء من ناحية تنظيم المجال العمراني الذي أدى إلى تشوه المنظر الجمالي للمدن وهذا لعدة أسباب الإجتماعية والإقتصادية والإدارية. وقد نتج عن هذه الظاهرة أي البناء غير المطابق لمواصفات رخصة البناء خلق نزاعات جزائية، فالمخالف لا يحترم أحكام رخصة البناء ومقتضياتها فهي جريمة لا تقل أهمية عن جريمة البناء بدون رخصة لما تخلفه من أضرار للغير ولما لها من تأثير على الجانب البيئي، وقد أصبح القاضي الجزائي هو المختص في فض النزاعات المتعلقة بجريمة البناء المخالف لأحكام رخصة البناء التي ينتج عنها تعدي على ملكية الغير أو الإضرار بالجار في فتح واجهات في غير محلها، أو الإخلال بأي التزام التي منحت من أجله رخصة البناء فلابد على القاضي فرض عقوبات صارمة على مرتكبي هذه الجريمة. Abstract: The crime of building in violation of the provisions of the permit is one of the most widespread violations in Algeria although issued legislator Algerian an arsenal of laws relating to the construction, but the situation in which Algeria bad in terms of organizing the urban which bed to distort beautiful landscape of cities and this for reasons social economic and administrative. As a result of this phenomenon create conflicts punitive perhaps most important disputes relating reconstruction, the violator does not respect its provisions of building permit this crime no less than a crime to build without a permit for the resulting damage to others and their impact on the environmental side, it has become the criminal court judge is competent to settle disputes on building an offence contrary to the provisions of the building permit produced the encroachment of the property of others or damage to the neighbor in the opening of the facades of misplaced, or breach of any commitment given by the building permit for a must, the judge imposed strict penalties on perpetrators this crime.
