الملخص
الوقف عقد تبرعي يؤدي إلى حبس العين عن التملك، ويظل محتفظا بالشخصية المعنوية التي تشكل أساس توظيفه وفق أساليب حديثة. وقد نص المشرع الجزائري على الوقف وطرق استغلاله بأساليب رآها حديثة مقارنة مع تشريعات أخرى التي نصت على أساليب أخرى رأتها حديثة ومفيدة. وأما أهداف البحث فتكمن في الوقوف على الأساليب الحديثة لاستثمار الوقف، ودعوة المشرع إلى تبني هذه الأساليب. و نتائج البحث فهي: إن الأموال الموقوفة لم تعد قاصرة على العقارات، بل شملت النقود في بعض الأنظمة المقارنة وأصبح الوقف يمول نفسه بنفسه. The elwaqf is a donation contract that leads to confinement in the possession of property, and remains a moral person that forms the basis of his elwaqf in accordance with modern methods. And the Algerian project stipulated the elwaqf and the methods of using it in ways it saw are new compared to other legislations that stipulated methods it saw as modern and useful. As for the objectives of the research, it was able of find out about modern methods, elwaqf investment and invite the legislator to adopt these methods. As for the results of the research, they are: that the suspended funds are on longer limited to real estate, but included money in some comparative systems.
