تأصيل فكرة النظام العام العمراني في التشريع الجزائري

الملخص
ملخص: سعت كل الشعوب وعبر مختلف العصور إلى تنمية مجتمعاتها، وحماية هويتها ومقومات وجودها واستمرارها. وباعتبار أن العادات والتقاليد وأنماط البناء والسكن تعد من بين هذه المقومات، فقد استعانت هذه الشعوب بجملة من الأفكار الفلسفية والقانونية، إستطاعت من خلالها بعث مبادئ وأسس نهضتها وبقائها كما تحمي من خلالها عناصر وجودها. ومن بين هذه الأفكار فكرة النظام العام التي تعبر عن مجموعة الأسس والقيم الضرورية لحماية المجتمع وضمان بقائه. غير أن مرونة وعمومية فكرة النظام العام من جهة وتطور الحياة الحضرية المعاصرة من جهة ثانية أدى إلى بروز مصالح أخرى جديرة بالحماية تتمثل في المصلحة العامة العمرانية ،وذلك من خلال تكريس وجه حديث من أوجه فكرة النظام العام وهو النظام العام العمراني. Abstract: Throughout all ages, all peoples have sought to develop their societies, protect the foundations of their existence and their continuation. Considering that customs, traditions, building patterns and housing are among these constituents, these peoples have used a set of philosophical and legal ideas through which they were able to create principles and foundations for their revival and survival, as well as protecting the elements of their existence. Among these ideas is the idea of public order, which expresses the set of foundations and values necessary to protect society and ensure its survival. However, the flexibility and generality of the idea of public order on the one hand, and the development of contemporary urban life on the other hand, has led to the emergence of other interests worthy of protection, represented in the urban public interest, by devoting a modern aspect of the idea of public order, which is the urban public order.
