الملخص
حقوق التأليف والنشر الموسيقي من أهم الإشكالات العلمية الحديثة في مجال المعرفة بشكل عام وفي مجال الفنون والعلوم الإنسانية بشكل خاص (الإبداع والتأليف والترجمة), لا يتعلق الطرح فقط بالتأليف الموسيقي وكيفية الحفاظ على المؤلفات الموسيقية و كيفية التوزيع العادل لعائدات الإنجاز الفني بين جميع المتعاملين، بما في ذلك المؤلف والمترجم والناشر والموزع والمهن الأخرى، ولكن أعمق من ذلك فيمس كل ما هو تراث وهوية أمة. كان هذا الموضوع ولا يزال منذ ألف وأربعمائة وستة وتسعين في فرنسا ، موضوع البحث الفني الأدبي الفكري (عندما عرض موضوع نسخ اللوحات الفنية والآلات الموسيقية على طاولة النقاش) تم عقد المؤتمرات ، وأبرمت المواثيق الدولية ، وسنت القوانين المحلية المنظمة لهذا الغرض وحفظ لكل ذي حق حقه, لن نعرض اليوم التطور التاريخي للملكية الفكرية وحقوق التأليف والنشر بقدر اهتمامنا بالواقع المعاش والمستقبل المأمول لمواكبة التقدم في هذا الميدان بالجزائر مثل البلدان الأخرى ، خاصة في عصر العولمة والتحولات الطارئة بعد جائحة كوفيد - 19 , تناولنا الإشكالية وفق تشريعية وفنية لإبراز أهمية حقوق المؤلف كمفكر مبدع (حفظ الملكية الفكرية والأدبية والفنية ). Music copyright is one of the most important modern scientific problems in the field of knowledge in general and in the field of arts and human sciences in particular (creativity, composition and translation), The proposal is not only related to musical composition, how to preserve musical compositions, and how to fairly distribute the proceeds of artistic achievement among all dealers, including author, translator, publisher, distributor, and other professions, but it goes deeper than that, touching everything that is the heritage and identity of a nation. Conferences were held, international charters were concluded, and local laws were enacted organizing this purpose and preserving everyone who has his right. We will not present today the historical development of intellectual property and copyright as much as we are concerned with the lived reality and the hoped-for future to keep pace with progress in this field in Algeria like other countries, especially in the era of globalization And the emergency transformations after the Covid-19 pandemic, we dealt with the problem according to a cognitive, legal and artistic approach to highlight the importance of copyright as a creative thinker (preserving intellectual, literary and artistic property).
