الإطار القانوني للبناء على العقار الفلاحي

الملخص
الملخص بالغة العربية: یلعب العقار الفلاحي دورا هاما في تحقیق الأمن الغذائي للدولة، وذلك بما یوفره من منتجات زراعية تساعد إلى حد كبیر على تحقیق الاكتفاء الذاتي في المجال الغذائي وتقلیل فاتورة الاستيراد الباهظة بالعملة الصعبة، ولهذا حرص القانون على حمایة هذا العقار بنصوص قانونیة وتنظیمیة صارمة تمنع البناء على هذا الوعاء و تكفل المحافظة علیه لاستعماله في الأغراض الزراعية البحتة، وهذا في إطار ضمان الدولة للاستغلال الرشید للموارد الطبیعیة والحفاظ علیها للأجیال القادمة، غیر أنه في بعض الأحیان وتحت ظروف قاهرة تدعو الحاجة إلى إقامة بناءات فوق العقارات الفلاحية لوجود مصلحة جدیرة بالرعایة، مما جعل المشرع یولي هذه المسألة أهمیة كبیرة وینظمها من جمیع جوانبها من الناحية التشريعية، ومن الناحية الرقابية على أرض الواقع. :Résumé L'immobilier agricole joue un rôle important dans la sécurité alimentaire de l'État en fournissant des produits agricoles qui contribuent dans une large mesu à l'autosuffisance dans le secteur alimentaire et en réduisantla facture exorbitante des importations en monnaie forte. Cela fait partie de l'assurance de l'État quant à l'utilisation rationnelle et à la conservation des ressources naturelles pour les générations futures. Parfois, dans des circonstances impérieuses, il est nécessaire de construire des bâtiments au-dessus des exploitations agricoles pour assurer un intérêt digne de soins, ce qui a amené le législateur à accorder une grande importance à cette question et à la réglementer sous tous ses aspects du point de vue législatif et en termes de contrôle sur le terrain. : Abstract The agricultural real estate plays an important role in achieving the food security of the state, through the provision of agricultural products that help to a great extent to achieve self-sufficiency in the food field and reduce the exorbitant import bill in hard currency. This is part of the state's assurance of the rational use and conservation of natural resources for future generations. Sometimes, under compelling circumstances, there is a need to build buildings above agricultural estates for the existence of a worthy interest in care, which made the legislator attaches great importance to this issue and regulates it in all its aspects from the legislative point of view, and in terms of control on the ground.
