الملخص
: يتناول هذا المقال آخر التعديلات الطارئة على الدائرة وهي الهيئة غير الممركزة التي تتوسط الجماعتين الإقليميتين؛ البلدية والولاية. ويتمثل الأمر في قرار السلطات العمومية - ابتداء من سنة 2015 - بتعويضها بهيئات غير ممركزة أخرى تدعى بالمقاطعات الإدارية. وكانت بداية إعادة النظر في هذا التنظيم الإداري على مستوى بعض الولايات الجنوبية ثم انتقلت العملية لتشمل سنة 2018 بعض المدن الكبرى في المنطقة الشمالية نظرا للمشاكل التي تتخبط فيها خاصة في الجانب المتعلق بالتنمية وتقريب الإدارة من المواطن. وقد أشرنا في المقال إلى عدم ملائمة النظام القانوني الحالي للدائرة منذ إلغائها من قانون الولاية، وأن عملية التعديل التي مست الهيئة ليست جديدة، حيث عرفتها في السابق ولاية الجزائر سنة 1997 عند إنشاء محافظة الجزائر الكبرى الملغى بسبب عدم دستوريته سنة 2000، آنذاك أنشئت دوائر إدارية يشرف عليها ولاة منتدبين بدلا عن الدوائر المرؤوسة من قبل رؤساء الدوائر. This article deals with the latest changes made to the Daïra, which is an institution of deconcentration placed between two local authorities, the municipality and the department. This is the decision of the public authorities, as of 2015, to replace the Daïra by another institution of the same nature called administrative district under the authority of the wali delegate instead of the chief of Daïra, the level of some southern wilayas. In 2018, it was expanded to include a few large cities in the northern region, due to the many problems they face, particularly with respect to the development and rapprochement. In this article, we have underlined the weakness of the legal status of the Daïra since its abrogation in the law of the wilaya, and that this administrative reorganization was preceded by that of 1997 in the wilaya of Algiers during the creation of the Governorate, its status was declared unconstitutional at the beginning of the year 2000.
