الملخص
الملخص: تهدف هذه الدراسة إلى تسليط الضوء على اجتهاد متميز عرفت به المدرسة الفقهية الحنفية،وقراءة المستندات التي على أساسها أبدع الأحناف مرتبة الفساد المتوسط للصحة والبطلان، كما تهدف أيضا إلى إبراز خصوصية الصناعة الفقهية الحنفية في هذا المحل وتمييزها الدقيق بين الفساد الأصلي والفساد العارض ومن ثم عدم التسوية بين أثر كل منهما على صحة التصرف الشرعي. وقد خلصت هذه الدراسة إلى جملة من النتائج منها إثبات أن مراعاة مقاصد التشريع الإسلامي في المذاهب الفقهية الإسلامية كان معتبرا وهو خلاف ما تروج له بعض الكتابات العربية المعاصرة التي تحاول إضفاء طابع الظاهرية على نتاجنا الفقهي القديم ونتجاهل ثراء الاجتهادات الفقهية القديمة وإمكانية استثمار منطقها وآلياتها في النظر في الوقائع الجديدة على مستوى المؤسسات الرسمية للفتوى والاجتهاد. كما خلصت هذه الدراسة إلى إثبات اتساق الفقه الحنفي مع أصله العام المتمثل في اعتبار المقاصد، حيث راعى هذه الأخيرة في خصوص قواعد الفساد والبطلان وفي الفروع الفقهية المخرجة عليها، ويظهر هذا التساق فيما استدل به لقواعده في الفساد والبطلان كما يظهر فيما نص عليه من التعديلات التي تعود إلى المقاصد في الفروع الفقهية الخاصة. Abstract This study aims to shed light on the distinguished jurisprudence for which the Hanafi school of jurisprudence is known, and to read the documents on the basis of which the Hanafis excelled at the average level of corruption in health and invalidity. It also aims to highlight the peculiarity of the Hanafi jurisprudence industry in this shop and its precise distinction between original corruption and accidental corruption and then not The settlement between the impact of each on the validity of the legitimate behavior This study concluded with a number of results, including the proof that the observance of the objectives of Islamic legislation in the Islamic jurisprudential schools of thought was considered contrary to what some contemporary Arab writings promoted that try to impart a virtual character to our old jurisprudential product and ignore the richness of old jurisprudential jurisprudence and the possibility of investing its logic and mechanisms in consideration In the new facts at the level of official institutions for fatwa and diligence. This study also concluded that the Hanafi jurisprudence is consistent with its general origin represented in the consideration of the objectives, as it took into account the latter in regard to the rules of corruption and invalidity and in the jurisprudential branches produced on them, and this consistency appears in what was evidenced by its rules on corruption and invalidity as appears in the provisions of the amendments that were made.
