ضوابط إعلان الحرب في الدستور الجزائري

الملخص
ملخص تهدف هذه الدراسة إلى كشف الضوابط التي تحكم إعلان الحرب في الدستور الجزائري، الذي نص صراحة على صلاحية رئيس الجمهورية في الاعلان عن الحرب في حالة وقوع عدوان فعلي على البلاد أو يوشك أن يقع، حاولنا في المبحث الأول التطرق إلى اعلان الحرب في مفهومه التقليدي والحديث لتحديد وجهة المؤسس الدستوري والكشف عن الفرق بين المفهومين، ثم التطرق في المبحث الثاني إلى الإجراءات الشكلية والموضوعية التي تسبق إعلان الحرب، مع التعليق على المواد ذات العلاقة بموضوع المشروع التمهيدي لتعديل الدستور. Abstract This study aims to reveal the controls governing the declaration of war in the Algerian constitution, which explicitly stipulated that the President of the Republic has the authority to declare war in the event of actual aggression against the country or is about to happen. In the first topic we tried to address the declaration of war in its traditional and modern concept to define The point of the constitutional founder and revealing the difference between the two concepts, then in the second topic, the formal and substantive measures that precede the declaration of war are discussed, with commentary on the articles related to the subject of the preliminary draft to amend the constitution.
