الملخص
الملخص: لقد شكل الطب الحديث قفزة نوعية في ابتكار طرق أدت إلى القضاء على العقم، حيث أصبح من الممكن الحمل والإنجاب بدون الاتصال بين الزوجين بفضل تقنية التلقيح الصناعي وصوره المختلفة. إلا أنه من الممكن أن يكون بين غير الزوجين وقد يكون بعد الوفاة مما يثير مشكل نسب المولود بهذه التقنية. هذا ما أثار العديد من المشاكل القانونية والآراء الفقهية فكان لابد من استحداث ضوابط شرعية وقانونية للحيلولة من التمادي في ذلك. الكلمات المفتاحية: زواج ؛ عقم؛ تلقيح صناعي بعد الوفاة؛ أطفال الأنابيب؛ نسب. Résumé : La médecine moderne a fait un bond en avant dans la conception de méthodes qui ont conduit à l'élimination de l'infertilité, car il est devenu possible de concevoir et de porter des enfants sans contact entre conjoints grâce à la technique de la FIV et de ses différentes formes. Cependant, il peut se faire entre des non-conjoints et ce peut être après le décès, ce qui pose le problème des proportions de nouveau-nés dans cette technique. C'est ce qui a soulevé de nombreux problèmes juridiques et opinions jurisprudentielles, il était donc nécessaire de développer des contrôles juridiques et juridiques pour empêcher la persistance dans ce domaine. Abstract: Modern medicine has qualitatively leaped forward in developping a new methods for fighting against infertility in conjugal relationschips. It becomes today possible for women to be bregnant by artificial insemination. Howevre , this technique might present a major concern when dealing with extramarital relations where different senarios are conceivables such as the pregnancy from a dead person which raises an affiliation dilemma. In this context , many efforts from a legislative and dogmatic point of views must be discussed.
