رخصة البناء كآلية لحماية البيئة في التشريع الجزائري

الملخص
لم يجعل المشرع الجزائري عملية البناء مطلقة، وفقا لما يبتغيه طالب البناء، بل قيد ذلك بتراخيص إدارية من أجل بداية عملية التشييد ومنها رخصة البناء، والتي تصدر عن جهات إدارية في شكل قرار إداري، قد يسمح بقبول الطلب وإتمام عملية البناء، وقد يكون هذا القرار سلبيا مدعم بأسباب رفض طلبه، فيكون من حقه تعديله أو استيفاء الشروط الباقية. كما تعتبر رخصة البناء إحدى الدعائم والآليات لحماية البيئة من المخاطر التي قد تلحقها جراء عملية التشييد خاصة إذا كانت مطلوبة في أمكان عامة وفلاحية وغيرها، ولذلك وضع المشرع الجزائري ترسانة قانونية واسعة من أجل حماية البيئة من جراء هذه المخاطر وهو ما جاءت به القوانين التي نصت على الحفاظ على البيئة. The Algerian legislator did not make the construction process absolute, according to what the applicant wanted, but rather restricted it with administrative licenses for the beginning of the construction process, including the building permit, which is issued by administrative authorities which is an administrative decision, which may allow the request and the completion of the construction process,, so he has the right to amend it or to fulfill the remaining conditions. The building permit is also considered one of the pillars and mechanisms for protecting the environment from the risks that it may suffer as a result of the construction process, especially if it is required in public,. the Algerian legislator has developed for laws and legislations that provided for the preservation of the environment
