مرجعية وتطور مبدأ حق الشعوب المستعمرة في تقرير المصير

الملخص
تعالج هذه الورقة البحثية مبدأ من مبادئ القانون الدولي العام والشرعية الدولية ألا وهو مبدأ حق الشعوب المستعمرة في تقرير المصير، من خلال التعريف به والرجوع إلى أهم الحقب التاريخية والثورات الكبرى (الثورة الفرنسية ــ الثورة الأمريكية)، التي كان لها الفضل في تطور وإرساء هذا المبدأ، و أضحى كقاعدة قانونية تضمنته معظم المواثيق الدولية، (ميثاق منظمة الأمم المتحدة والعهد الدولي لحقوق الإنسان الجماعية)، تستند إليه الشعوب المستعمرة المتطلعة إلى الاستقلال في كفاحها ضد المستعمر. كما سوف يتم التطرق إلى الطبيعة القانونية والسياسية لمبدأ حق الشعوب المستعمرة في تقرير المصير ضف إلى أهم وسائل تطبيقه من وسائل شرعية وأخرى غير شرعية، تقرها المواثيق الدولية. The aim of the paper is to analyses one the fundamental principles of the international law ,that is the right for self- determination for of all people under colonialism through a scientific and historical study including comparative arguments with revolutions claimed equality and human rights such as the French and American Revulsions .The latter which should have become become a reference for all people fighting for independence and liberation from colonialism, but in action the countries of these revultions themselves bacame colonialiast or oppressed powers. In addition the paper includes an analysis of the legal and political nature of self- determination in practice and action.In reality double standard has been dominent once the right for self determination is put in action, in some cases the principle of self- determination has been rapidly applied such as in the case of East Timor whereas others have been ignored, Palestine and Western Sahara are clear examples.
