الملخص
ملخص المقال بالعربية. جاء هذا المقال للكشف عن مسألة تحتاج إلى بعد نظر، وهي مدى قوة الاتجاه المقاصدي في نقد نوازل المعاملات المالية عند المالكية؟ وقد سلكتُ مسلك التأصيل والتطبيق؛ للكشف عن ذلك من خلال بيان أهم القواعد التي يحوم حولها الاتجاه النقدي المقاصدي، وهي: قاعدة المصالح وما حوت من سد الذرائع، ومراعاة مقاصد المكلفين، ومن خلال ثلاثة نوازل، ذكرها العلامة الونشريسي- - في المعيار، كلُّها لها صلة بالقواعد السالفة الذكر؛ لأن من أهداف هذه الدراسة خدمة المذهب المالكي، والكشف عن جوهر الفقه إذا كان بين الكبار، وهو ما أظهر أنَّ مقاصد الشريعة مورود معين في نقد نوازل المعاملات المالية. ملخص المقال باللغة الإنجليزية This article came to reveal an issue that needs to be farsighted, namely, how strong is the maqasid direction in the critique of the cataclysms of financial transactions at Al-Malikiyah? I have followed the path of rooting and implementation to reveal this by explaining the most important rules around which the intentional monetary direction is hovering, namely: the rule of interests and the containment of excuses, and taking into account the intentions of the taxpayers, and through three cataclysms, mentioned by Al-Wenchiri - in the standard, all of them have Relevant to the aforementioned rules, because one of the aims of this study is to serve the Maliki school of thought, and to reveal the essence of jurisprudence if it is among adults, which showed that the purposes of Sharia are a specific resource in the critique of financial transactions.
