الملخص
ملخص: إن حرية الترشح للوظائف والمناصب السياسية الانتخابية في الدولة، تعتبر أحد أبرز وأهم الحريات السياسية، لارتباطها بمبدأ سياسي هام وهو مبدأ التداول على السلطة، والذي يقوم على مشاركة المواطنين في تسيير الشؤون العامة للبلاد عن طريق تولى المناصب في الدولة، و التي يكون إسنادها عن طريق نمط الانتخاب سواء على المستوى الوطني أو المحلي، ويكون الترشح إما ضمن أحزاب سياسية، وهو الغالب، باعتبار أن الأحزاب السياسية أصبحت في عصرنا الحاضر، من أهم الآليات التي تساهم في إرساء مبدأ التشارك في ممارسة السلطة، وإما يكون الترشح ضمن قوائم حرة. إلا أن المؤسس الدستوري في جل الدول، خول للمشرع تنظيم الحريات العامة، ومن ذلك حرية الترشح للانتخاب، وجعلها من الموضوعات المحصورة له دون سواه من السلطات، ومن ثم يقوم بتنظيمها وضبطها، وتحديد الشروط القانونية للترشح، وأساليب الضبط الإداري التي تتدخل بها هيئات الضبط الإداري لتنظيمها، لضمان عدم الحد منها أو التضييق عليها، لأن هذه الهيئات الإدارية هي جزء من السلطة التنفيذية. ABSTRACT: The freedom to run for political positions and positions in the state is considered one of the most important and important political freedoms because of its association with an important political principle, Which is based on the participation of citizens in the conduct of public affairs of the country by taking office in the state, which is supported by the pattern of election, whether at the national or local level, The nomination is either within political parties, and most often, as political parties have become, in our time, one of the most important mechanisms that contribute to the establishment of the principle of participation in the exercise of power, or to be on the list of free. However, the constitutional institution in most countries allowed the legislator to regulate public freedoms, including the freedom to stand for election, and to make it one of the subjects confined to him and no other authorities, and then organize and control it, determine the legal conditions for candidacy, To ensure that they are not limited or restricted, because these administrative bodies are part of the executive branch.
