الملخص
يعتبر استخدام السلاح أو التهديد باستخدامه خطرا على الإنسانية جمعاء نظرا لقوته التدميرية الهائلة، خاصة في ظل عدم وجود نصوص قانونية تحظره، أو وجود نصوص قانونية ولكنها قاصرة وعاجزة عن مجابهته، نتيجة لذلك تدخل المشرع الجزائري بترسانة من النصوص القانونية قصد وضع حد للاستخدام غير المشروع للسلاح، الأمر الذي اعتبره الدارسين خطوة ايجابية من المشرع في هذا الصدد، لكن مع ذلك لازال هذا الردع التشريعي قاصرا عن وضع حد للاستخدام غير القانوني للسلاح في الجزائر خاصة من حيث المتاجرة به، هذه الأخيرة تشكل الصورة الأخطر للتعامل بالأسلحة. The use of a weapon or the threat of its use is considered a threat to all of humanity in view of its massive destructive power, especially in the absence of legal texts prohibiting it, or the presence of legal texts but it is incomplete and unable to confront it, as a result of which the Algerian legislator intervened with an arsenal of legal texts in order to put an end to the illegal use of the weapon , Which the scholars considered a positive step from the legislator in this regard, but nonetheless this legislative deterrent is still unable to put an end to the illegal use of weapons in Algeria, especially in terms of its trade, the latter constitutes the most dangerous form of dealing with weapons. L'utilisation d'une arme ou la menace de son utilisation est considérée comme une menace pour toute l'humanité au regard de son pouvoir destructeur massif, notamment en l'absence de textes légaux l'interdisant, ou la présence de textes légaux mais elle est incomplète et incapable d'y faire face, à la suite de quoi le législateur algérien est intervenu avec un arsenal de textes juridiques afin de mettre fin à l'usage illégal de l'arme , Ce que les savants ont considéré comme une avancée positive du législateur à cet égard, mais néanmoins cette dissuasion législative n'est toujours pas en mesure de mettre un terme à l'utilisation illégale d'armes en Algérie, notamment en termes de commerce, cette dernière constituant la forme la plus dangereuse de manipulation des armes.
