تجريم عملية نقل الدم الملوث -دراسة مقارنة- Criminalization Of Contaminated Blood Transfusion -comparative Study-

الملخص
ببفضل تقدم العلوم الحديثة تم اكتشاف كثير من الأمور التي كانت مجهولة ،سواء في الكون أو في الإنسان، و من بين ما أفاد به التقدم في العلوم الطبية الحديثة أنه مكّن الأطباء من معرفة مكونات الجسم البشري و معالجة ما كان صعبا في السابق. و مما توصل إليه علم الطب الحديث أن عملية نقل الدم تعتبر من الطرق العلاجية ، حيث أن الدم يمثل سببا من أسباب الحياة بإنقاذ عدد كبير من المرضى و المصابين عند تعرضهم للخطر، و بذلك يتم نقله من شخص سليم إلى المريض، حيث أنه لا يمكن استحضار الدم صناعيا، و لا يمكن الاستفادة من دماء الحيوانات لسد النقص لدى الإنسان. فالدم يعطى للمريض وقت السلم و وقت الحرب، و لكن في بعض الحالات و نتيجة الإهمال أو عدم الانتباه، أو التعمد من المتبرعين أو من طرف العاملين في مجال نقل الدم و حفظه، يمكن إصابة متلقي الدم بداء خطير أو مرض معدي. إذ أن عملية نقل الدم تستعمل في بعض الحالات كأداة لارتكاب جرائم القتل و الإيذاء بدلا من كونها أداة علاجية ، و في هذه الحالة لابد من تقرير مسؤولية جزائية عن تلك الأفعال. By dint of the advance of modern science, many things that were unknown, both in the universe and in man, have been discovered. Progress in modern medical science has made it possible for physicians to know the components of the human body and to address what has been difficult in the past. The modern medical science has concluded that blood transfusion is a treatment method. Blood is a cause of life. It saves a large number of patients and the injured when they are at risk. This is transferred from a healthy person to the patient, since it can not be invoked. The blood is artificial, and the blood of the animals can not be used to fill the human deficiency. Blood is given to the patient in peacetime and wartime, but in some cases due to negligence or lack of attention, or the intent of donors or by the workers in the field of blood transfusion and conservation. Blood recipients can be infected with serious illness or infectious disease. In some cases blood transfusion is used as a tool for murder and victimization rather than as a therapeutic tool, in which case a criminal responsibility for such acts is to be determined.
