الأليات الحديثة في تنفيذ الأحكام القضائية الإدارية دراسة مقارنة

الملخص
الملخص: تطرق هذا البحث لمسألة تنفيذ الأحكام القضائية الإدارية، وما طبق من آليات حديثة في هذا المجال؛ في كل من فرنسا كمهد للقضاء الإداري، والنظام القانوني الجزائري، حيث نجد أن للنظام القانوني الفرنسي أليات فعالة وضامنة لتنفيذ الأحكام القضائية، منها توجيه أوامر للإدارة حتى تلتزم بتنفيذ الأحكام القضائية، ومنها أيضا فرض غرامة تهديدية على الإدارة في حال تعنتها وعدم تنفيذها للأحكام الصادرة عن القضاء. وقد تطرقت فيه للإصلاحات التشريعية الفرنسية في هذا المجال وتحليلها ابتداء من سنة 1980 تاريخ الإصلاح التشريعي الأول، وذلك فيما يتعلق بتوجيه الأوامر للإدارة وفرض الغرامة عليها عند عدم التزامها بتنفيذ الأحكام الصادرة بحقها، ثم من خلال إصلاح سنة 1995، والذي وسع من مجال هذه الإصلاحات، ثم محاولة مقارنتها بما أخذ به المشرع الجزائري في ذلك، وهل حذا حذو المشرع الفرنسي، أم أنه سلك مسلك أخر. ليتم التوصل في هذا البحث إلى نتائج، وتوصيات.. Abstract: This research addressed the issue of the implementation of administrative judicial rulings, and the modern mechanisms applied in this area; both in France as a cradle of the administrative judiciary, and the Algerian legal system. The French legal system has created effective and guaranteed mechanisms for the enforcement of judicial decisions; these include directing the administration to comply with judicial rulings, as well as imposing a threatening fine on the administration in case of intransigence and failure to execute judgments. In this research, I studied and analyzed the French legislative reforms in this field, starting in 1980, the date of the first legislative reform, with regard to directing the administration and imposing a fine on it when it did not comply with its sentences and then through the 1995 reform, which expanded the scope of these fixes. Then try to compare it with what the Algerian legislator took, and did he follow the example of the French legislator, or did he take another course? Perhaps the most important is the weakness of the Algerian legal system in the implementation of administrative judgments. I recommended the need to find new reforms by the Algerian legislator to cope with the French experience and what it has achieved in the implementation of administrative judicial rulings.
